COLLECTION OF INFORMATION
The Visory collects two types of information from visitors to the Site: personal information and non-personal information. Personal information is information that directly or indirectly identifies you as an individual. If information is not personal information, it is non-personal information.
The Visory may collect non-personal information during your visit to the Site through automatic data collection tools, which may include cookies (small pieces of data stored on a user’s browser that contain non-personal information about the user) and other commonly used information-gathering tools. These tools collect certain standard information that your browser sends us when you visit the Site, such as your browser type and language, access times and your Internet Protocol (“IP”) address.
HOW THE VISORY USES YOUR INFORMATION
If you provide The Visory with your name and email address, we may use the email address that you provide to respond to your inquiries and requests and send you information and updates about The Visory and investment opportunities. If you do not want to receive communications from us, please indicate your preference by emailing us at the email address provided above or by clicking on the “Unsubscribe” link at the bottom of an email message.
The Visory may use non-personal information provided voluntarily by you or collected automatically by cookies and other information-gathering tools to learn about how you use the Site, how The Visory can improve the quality and usefulness of the Site or for other purposes that The Visory may deem appropriate.
HOW THE VISORY SHARES YOUR INFORMATION
- The Visory respects your privacy and will not sell, rent or otherwise disclose your personal information to any third party, except in the following circumstances:
- In response to a subpoena, court order or a request for cooperation from law enforcement agencies;
- To defend against legal claims;
- When it is necessary in The Visory’s opinion to do so to prevent, investigate, detect or prosecute criminal offenses or attacks on the technical integrity of the Site or The Visory’s network;
- To protect The Visory’s rights, property and safety;
- In the event that The Visory participates in a substantial corporate transaction, such as the sale of its business or a merger or consolidation with a third party; and
- As otherwise required by law.
The Visory will not share any of your personal information with third parties for direct marketing purposes. However, please note that California Civil Code Section 1798.83 permits California residents to request and obtain from The Visory a list of what personal information (if any) The Visory disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge.
YOUR CONTROL OVER YOUR INFORMATION
You cannot view the information The Visory has collected from you through the Site. However, the only personal information The Visory collects through the Site is the personal information you voluntarily provide to The Visory. You may also request that The Visory delete your personal information by emailing The Visory at the email address provided above.
Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites that you do not wish such operators to track certain of your online activities over time and across different websites. Our Site does not support Do Not Track requests at this time.
HOW THE VISORY PROTECTS YOUR PERSONAL INFORMATION
The Site uses reasonable measures to help protect your personal information from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction.
Please note that no information security practices are 100% secure or immune from circumvention. We cannot give you an absolute guarantee that your personal information will always be secure. If we learn of a security breach that jeopardizes, or may jeopardize, the security and confidentiality of your personal information, we will attempt to notify you electronically (subject to any applicable laws) at the email address you have provided through the Site so that you can take appropriate protective steps.
The Visory is committed to protecting the privacy of young children, and therefore does not knowingly collect personal information from persons under 13 years of age through the Site. No part of the Site is directed to persons under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE SITE AT ANY TIME OR IN ANY MANNER. In the event that The Visory discovers that personal information has been collected from a person under 13 years of age, without verified parental consent in accordance with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), The Visory will immediately delete such information.
